Welcome to ADR Solutions. My name is Lou Schmitt and since 1987, I have represented plaintiffs and defendants in litigation. I have handled thousands of cases. I have been through well over a hundred civil jury trials.
Going to trial is perhaps the worst way to resolve a dispute. It is expensive. It is time consuming. It is public. It is extremely unpredictable. The parties surrender control over their dispute to either a bunch of strangers, or to a very busy judge.
Do yourself a favor. The next time you're at Wal-Mart, or the mall, or the county fair, or any other public gathering - look around. These are the same people who will be on your jury. They don't know you. They don't care about you. And they don't care about your dispute. And neither will the jury if you go to trial.
Is there a chance that a party will get everything it wants at trial? Sure. But there is a distinct possibility that won't happen. I have seen countless parties who went to trial with "Can't Lose" cases - and lost! Even if one side does win, there may be post-trial litigation, and appeals. It could take years and cost a lot of money before the dispute is finally resolved. And appeals are as unpredictable as trials.
